The Northern Team is pleased to have obtained a Certificate of Lawfulness for a client in Lancashire.
The situation related to a planning application for a replacement dwelling where the existing farmhouse was conditioned to be removed once the replacement dwelling was built and first occupied. However, the original farmhouse was never demolished and has remained in use for over 10 years following the occupation of the replacement dwelling. Therefore a breach of condition had occurred for over 10 years and a Certificate of Lawfulness was secured for the retention of the original farmhouse.
